Acceptance of terms
These Terms of Service (“Terms”) are a binding agreement between you and WeaveHub Technologies LLC, doing business as Forkd (“Forkd,” “we,” “us,” or “our”). By creating an account or otherwise using the Forkd mobile app, web app, or marketing site (collectively, the “Service”) you agree to be bound by these Terms and by our Privacy Policy.
If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
Service description
Forkd is an AI-assisted dining recommendation app. You scan or select a menu, we compare every dish on it against your personal taste profile, and we rank the dishes most likely to delight you. The Service includes the mobile app, the web app, and any accompanying features and content we provide.
Account eligibility
- You must be at least 13 years old to use the Service.
- You must provide accurate sign-in information and keep it up to date.
- You may not create more than one personal account. We may merge or disable duplicate accounts.
- You are responsible for keeping your sign-in credentials secure and for everything that happens under your account.
Subscription & billing
Forkd offers two tiers:
- Forkd Free — 5 menu scans per month, full taste profile, allergy warnings. No payment required.
- Forkd Pro — unlimited scans, group ordering, travel mode, and additional features. $7.99 per month after a 7-day free trial. Annual pricing may also be offered.
Subscriptions are processed by the Apple App Store, the Google Play Store, or RevenueCat acting on our behalf. Your subscription renews automatically at the end of each billing period unless you cancel at least 24 hours before renewal. You can cancel at any time through the App Store, Play Store, or web subscription settings; cancellation stops future charges but does not refund the current period.
Refunds are handled according to the policies of the platform you purchased through (Apple, Google, or our web payment processor) and may be granted at their discretion.
Acceptable use
You agree not to:
- Use the Service for any unlawful purpose, including violation of export controls, sanctions, or local food-safety regulations.
- Scrape, mirror, or otherwise mass-download data from the Service.
- Reverse-engineer, decompile, or attempt to extract the source code of the Service, except where this restriction is prohibited by law.
- Resell, sublicense, or commercialize the Service or its outputs without our written permission.
- Upload malicious files, exploit security vulnerabilities, or interfere with other users.
- Upload menu images you do not have the right to use, or content that infringes anyone’s intellectual-property or privacy rights.
Your content & taste profile
You retain ownership of the content you provide to Forkd: your ratings, your favorites, your dislikes, your dining sessions, and your taste profile. By using the Service, you grant Forkd a worldwide, non-exclusive, royalty-free license to use this content solely for the purposes of operating the Service for you — including computing your recommendations, syncing across your devices, and improving our recommendation models in aggregate.
We do not sell your content, and we do not share it with advertisers. You can export or delete your content at any time as described in the Privacy Policy.
Recommendations are suggestions
Allergen flags are best-effort warnings derived from menu text. Menus change. Kitchens make mistakes. Cross-contamination happens. [REVIEW WITH COUNSEL]
- Always read the actual menu before ordering.
- Always tell the restaurant about any allergy, intolerance, or dietary restriction.
- If a meal is safety-critical for you, verify ingredients directly with the restaurant. Do not rely on Forkd alone.
You agree that Forkd is not responsible for adverse reactions, allergic reactions, dietary failures, or other consequences of relying on a Forkd recommendation.
Restaurants & menus
Forkd is not affiliated with any restaurant unless we explicitly say so. We do not control restaurant operations, ingredient sourcing, preparation, pricing, hours, availability, or quality. Menu data may be out of date; specials may not be captured; prices may have changed; items may be sold out.
We make no warranty about any restaurant’s products or services. Your interaction with any restaurant is solely between you and that restaurant.
Intellectual property
The Forkd name, the Forkd mark, the app, the website, the recommendation engine, and all related software, designs, and content are owned by WeaveHub Technologies LLC and protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or trade dress without our prior written permission.
We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use, subject to these Terms.
Termination
You can terminate this agreement at any time by deleting your account from the in-app settings or by emailing privacy@tryforkd.com. Deletion is permanent and irreversible; cancelled subscriptions do not automatically delete your account.
We may suspend or terminate your account if you violate these Terms, if your account is used fraudulently, or if continuing to provide the Service is no longer commercially reasonable. We will give you reasonable notice where we can.
Disclaimers
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, Forkd disclaims all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that recommendations will match your subjective taste.
Limitation of liability
To the maximum extent permitted by law, WeaveHub Technologies LLC, its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
[REVIEW WITH COUNSEL] Our total aggregate liability to you for any claim arising out of or related to these Terms or the Service shall not exceed the greater of (a) the subscription fees you paid Forkd in the twelve months preceding the claim, or (b) one hundred US dollars ($100).
Some jurisdictions do not allow these limitations; in those places our liability is limited to the smallest amount the law allows.
Indemnification
[REVIEW WITH COUNSEL] You agree to defend, indemnify, and hold harmless WeaveHub Technologies LLC and its affiliates from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising out of (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any third-party right.
Governing law & disputes
[REVIEW WITH COUNSEL] These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Any dispute arising out of or related to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You and Forkd waive any right to a jury trial or to participate in a class action, except where prohibited by law.
If you are a consumer in the European Union, the United Kingdom, or another jurisdiction where mandatory local law overrides the above, that local law applies and you may bring claims in your local courts.
Changes to these terms
We may update these Terms from time to time. When we make material changes we will notify you by email and via an in-app banner at least 14 days before the changes take effect. Continued use of the Service after the effective date means you accept the updated Terms. If you do not accept them, you must stop using the Service.
